Hereinafter referred to as ‘TSI SAS’.

Baobab Sounds is a digital platform for creating personalized musical content assisted by artificial intelligence, including:

• personalized songs,
• emotional audio content,
• musical creations for events,
• cultural sound experiences.

The service is accessible via:

• website,
• web application,
• future mobile and digital platforms.

Use of the service constitutes full and unconditional acceptance of these Terms of Use.

Every user acknowledges that they:

• have the necessary legal capacity,
• use the service in accordance with applicable laws,
• provide accurate information.

TSI SAS endeavors to ensure continuous access to Baobab Sounds.

However, access may be suspended:

• for maintenance,
• for technical reasons,
• in the event of force majeure,
• or to improve features.

TSI SAS does not guarantee uninterrupted availability.

The user may provide:

• texts,
• memories,
• messages,
• emotional information,
• cultural elements,
• musical guidance.

These elements are used to generate personalized musical content through artificial intelligence technologies.

TSI SAS does not guarantee:

• the complete absence of errors,
• linguistic perfection,
• or absolute cultural accuracy of generated content.

The service relies in part on third-party artificial intelligence technologies.

Baobab Sounds must not be used for content that is:

• hateful,
• defamatory,
• discriminatory,
• pornographic,
• illegal,
• infringing third-party rights,
• impersonating another person,
• contrary to public policy.

TSI SAS reserves the right to immediately suspend any non-compliant account or content.

The Baobab Sounds brand, its logos, visual identity, interface, texts, graphic elements and technologies are protected by intellectual property law.

Any unauthorized reproduction is prohibited.

The user retains the rights to the content they submit.

However, the user authorizes TSI SAS to:

• process this content,
• use it for technical purposes,
• store it temporarily,
• generate the requested musical creations.

Unless expressly stated otherwise, generated creations are intended for personal, non-exclusive use. Any substantial commercial exploitation requires prior written agreement from TSI SAS.

Prices are displayed before the order is confirmed.

Payments are processed by our provider Stripe and may be made using:

• payment cards (Visa, Mastercard, American Express),
• Apple Pay and Google Pay,
• PayPal.

Any confirmed order is considered binding.

If the first song contains a significant error concerning the first name, chosen language or information provided, Baobab Sounds will generate a new version free of charge.

No ‘satisfaction guaranteed’ promise or refund for a change of mind is offered: given the personalized nature of the generated creations, orders are non-refundable once the content has been generated, except in the event of a proven technical malfunction attributable to Baobab Sounds.

Corrections included according to the package ordered:

• Essentielle: no discretionary corrections; free regeneration in the event of a significant error reported within 48 hours.
• Signature: 1 correction included, to be requested within 48 hours of delivery.
• Cérémonie: 2 corrections included, to be requested within 72 hours of delivery.

A correction may concern:

• the spelling of a first name or surname,
• a factual detail provided (date, place, family relationship),
• the requested language or pronunciation,
• an adjustment to the lyrics text already provided.

The following cannot be changed after generation:

• the musical style and voice selected when ordering,
• the duration and structure of the song,
• the artistic interpretation and arrangement generated by AI,
• the package ordered (no package changes after payment).

A full regeneration is carried out free of charge in the event of:

• a significant error in the first name, language or information provided,
• unusable or incomplete audio,
• a song that does not match the occasion specified when ordering.

Once the deadline applicable to the package has passed, the order is deemed accepted and no further corrections may be requested.

TSI SAS cannot be held liable for:

• misuse of the service,
• content provided by the user,
• a temporary interruption,
• technical limitations associated with partner AI systems,
• or indirect loss or damage.

The user remains responsible for the content they submit.

Data processing is detailed in the Privacy Policy available on the platform.

The Baobab Sounds service is hosted by:

Lovable (Lovable Labs Incorporated)
Cloudflare, Inc. edge infrastructure.
Database and storage operated through Lovable Cloud’s managed infrastructure.

TSI SAS may amend these Terms of Use at any time.

New versions apply upon publication.

These Terms of Use are governed by French law.

Any dispute shall fall within the jurisdiction of the competent French courts, unless otherwise provided by law.
